Empowering Girls Through Education

Indian government statistics hold the national literacy to be around 64.84%.Government statistics of 2001 also hold that the rate of increase of literacy is more in rural areas than in urban areas. Female literacy was at a national average of 53.63% whereas the male literacy was 75.26%. Within the Indian states, Kerala has shown the highest literacy rates of 90.02% whereas Bihar averaged lower than 50% literacy, the lowest in India. The 2001 statistics also indicated that the total number of ‘absolute non literates’ in the country was 304 million

India is the worlds largest democracy where billions of people live and almost half of these are women. So how does woman effect Indias development?
If girls are not educated, families suffer too. Educated mothers use their knowledge to improve the health of their children and other family members. They immunize their kids against major disease. They provide better nutrition. Their knowledge about health risk protects their families against illness. Child mortality rate is much higher where mothers lack education than in families where mothers are educated.

Another barrier to education in India is the lack of adequate school facilities. Many states simply do not have enough classrooms to accommodate all of the school-age children. Furthermore, the classrooms that are available often lack basic necessities such as sanitary facilities or water. In Uttar Pradesh, a recent survey found that 54 percent of schools did not have a water supply and 80 percent did not have latrines (The World Bank, 1997b). Lack of latrines can be particularly detrimental to girls school attendance. Negative parental attitudes toward educating daughters can also be a barrier to a girls education. Many parents view educating sons as an investment because the sons will be responsible for caring for aging parents. On the other hand, parents may see the education of daughters a waste of money because the girls are not expected to make economical contribution in the family. They are expected to take care of family and carry out household chores. Promoting girls education therefore involves changing attitude across society merely spending money on girls education will not solve this problem.

Imparting good education doesnt require building, uniform and even books but it does require good teacher. Thus women’s education should be taken as a serious issue and steps should be taken to bring awareness about importance of education among every woman both in urban and rural area. This way many of the social problems like poverty, begging, child labor, child marriage and child mortality will be controlled up to some extent.

Indian Education System At A Glance

Roots of education in India have been dated back to ancient times. Education in India falls under the control of both the Union Government and the states, with some responsibilities lying with the Union and the states having autonomy for others. Indian constitution has bestowed the citizens with education as the fundamental right.
The main contributors to economic growth in India have been cited to increased rate of literacy approximated to almost two thirds of the population. According to industry sources, the private education market in India is estimated to be worth $40 billion in 2008 and will increase to $68 billion by 2012. Despite growing investment in education, 35% of the population is illiterate and only 15% of the students reach high school. Among the engineering and polytechnic institutions about 57% of college professors lack either a master’s or PhD degree. Shortage of trained and quality faculty is becoming an increasing concern for institutions.
The Indian government lays emphasis to primary education up to the age of fourteen years referred to as -Elementary Education in India. The Indian government has also prohibited child labour in order, to ensure that the children do not enter unsafe working conditions. 80% of all recognized schools at the Elementary Stage are government run or supported, making it the largest provider of education in the Country. Right of Children to Free and Compulsory Education Act 2009 bestows children from six to 14 years of age or up to class VIII free education. However, due to shortage of resources and lack of political will, this system suffers from massive gaps including high pupil teacher ratios, shortage of infrastructure and poor level of teacher training. The current scheme for universalization of Education for All the Sarva Shiksha Abhiyan is one of the largest education initiatives in the world. This accounts for an increase of Rs 4,236 crore from the 2009-10 fiscal.
According to the Census of 2001, “every person above the age of 7 years who can read and write in any language is said to be literate”. There is a wide gender disparity in the literacy rate in India, an adult (15+ years) the literacy rates in 2009 were 76.9% for men and 54.5% for women. According to a study by industry sources, estimates of 80% of all schools are government schools making the Government the major provider of education. However, because of poor quality of public education, 27% of Indian children are privately educated.
India viewed education as an effective tool for bringing social change through rural community development and hence came up several initiatives. Nursery schools, elementary schools, secondary school, and schools for adult education for women were set up through the Gandhigram Rural Institute for rural education.

Payment Of Education Cess From Credit Of Basic Excise Duty

Sometime Credit in the account of one or more heads of Excise duty i.e Cenvat, Education Cess & SHE Cess has been piled up due to various reasons. Now the question is whether payment of one head can be done from the Cenvat credit lying unutilized in Account of other head.

The answer of the above question is given in Rule 3 of Cenvat Credit Rule 2004. As per Proviso to Rule 3(7) (b) of Cenvat Credit Rule 2004 which are produced below there is a restriction regarding use of Cenvat Credit of Education Cess & Secondary Education Cess for payment of only Education Cess & Secondary Education Cess but there is no vice versa restriction which means that Cenvat Credit of Education Cess & Secodary Education Cess can be used for payment of Education Cess & Secondary Education Cess only, no cross adjustment is possible in this case.

Proviso to Rule 3(7) (b) of Cenvat Credit Rule 2004

Cenvat credit built up out of education cess can be utilized only for payment of education cess on excise duty and service tax. It can not be utilized for the payment of excise duty, service tax and secondary higher education cess.

Cenvat credit built up out of secondary higher education cess can be utilized only for payment of secondary Education cess on excise duty and service tax. It can not be utilized for the payment of excise duty, service tax and education cess.

As far as utilisation of Cenvat Credit of Basic Excise Duty is concerned there is no such clause which restricts the assessee from using the Cenvat Credit of Basic Excise Duty for payment of Education Cess & Secondary Education Cess. So if there is no restriction then Cenvat credit of Basic Excise Duty can be used for payment of Education Cess & Secondary Education Cess. In addition to this the same issue has been already decided in case of 2009 (233) ELT 0221 (Tri. – Ahmd.) Commissioner of Central Excise, Vapi Versus Donear Inds. Ltd. by holding that credit of Basic Excise duty can be utilized for payment of any duty of excise.
